About the Appellate Department

The Appellate Department represents Utah in appeals, ensuring laws are applied correctly and justice is upheld. Led by Solicitor General Stanford Purser, the team handles hundreds of cases each year in state and federal courts, from criminal convictions to complex civil disputes. Their work helps shape legal precedent, defend state laws, and protect the rights of all Utahns.

The Department also plays a key role in clarifying statutes, defending laws, and protecting the public interest. Instead of re-trying cases, appellate attorneys focus on reviewing legal decisions for errors and ensuring the law was applied properly. Whether filing a response to an appeal or petitioning a higher court, their work reinforces the integrity of Utah’s justice system and provides consistent representation for the state’s position.

Each year, the department handles hundreds of appeals that influence how laws are interpreted and applied across Utah. Civil Appeals

Operating within the Appellate Department under the direction of the Solicitor General, the division represents the state in civil appellate litigation before the Utah Supreme Court and other appellate courts. The division defends the state’s legal victories on appeal and seeks reversal of erroneous adverse decisions. It works closely with trial attorneys throughout the office on complex matters, including appeals arising from administrative actions, district court rulings, and questions certified to the Utah Supreme Court. The division handles nearly all civil appellate cases involving the state and its agencies, officers, and employees represented by the office. Civil Appeals also prepares amicus briefs on significant appellate issues affecting Utah law, even when the state is not a direct party.

criminal appeals

Operating within the Appellate Department under the direction of the Solicitor General, the division defends successful criminal convictions on appeal and promotes fair treatment for both victims and defendants. It represents the state of Utah in all statewide appeals from capital and felony convictions, as well as juvenile delinquency adjudications. The division also represents the state in all state post-conviction and federal habeas proceedings, including death penalty challenges, and advises county prosecutors on criminal law and procedure, particularly in capital cases and matters involving complex search-and-seizure issues.

constitutional defense and special litigation

Lawsuits challenging the constitutionality of state law (that are not covered by indemnification for civil liability for money damages in the Risk Fund) are defended by CDSL under the supervision of the Solicitor General.
