A Second Look at First-Degree Felony Cases

About Felony Review

Pursuant to Utah Code Ann. § 67-5-1(2), the Office of the Utah Attorney General accepts select cases for independent review after they have been investigated, screened, and declined for prosecution by a district or county attorney.

Victims, or their legal representatives, may submit a request for review to the OAG Justice Division for further consideration. Each request is promptly evaluated to determine whether it meets the statutory criteria under the law. If the criteria are satisfied, the victim or representative is contacted to proceed with the next steps in the review process.

To refer a case, please follow the following instructions.

  1. Obtain a complete police report of your case.

    • You can do this through a GRAMA (Government Records Access and Management Act) request to the police agency that investigated your case.

  2. Send a WRITTEN request with a brief summary of the facts of your case and your representative’s contact information to:

Your request will be quickly evaluated to determine whether your case meets the review criteria of the new law. If the criteria are met, you or your representative will be contacted for the next steps.
